CONSTITUTION

In the absence of the Chairman, the Principal Administrator chaired the meeting and called for nominations for Chairman of the meeting.

It was agreed to appoint Mr Archie K Campbell as Chairman of the meeting.

Alter House Roof at 21 North Shawbost, Isle of Lewis

PLANNING APPLICATIONS

The Acting Director of Environmental Services submitted a Report concerning an application for planning permission for the alteration of the house roof at 21 North Shawbost, Isle of Lewis. It was intimated in the Report that, as the applicant was the brother of Mrs Catherine Leary, Planning Officer, Environmental Services Department, the matter had been referred to the Sub-Committee for determination. It was further stated that the proposals, as submitted, were in conformity with planning legislation.

   

It was agreed that the Acting Director of Environmental Services be authorised to grant planning permission for the alteration of the house roof at 21 North Shawbost, Isle of Lewis, subject to the conditions detailed at Appendix 1 of the Report.

Erect House at 30 Newmarket, Isle of Lewis

The Acting Director of Environmental Services submitted a Report concerning an application for outline planning permission for the erection of a house at 30 Newmarket, Isle of Lewis. The Report gave background information and indicated that representations had been received.

   

It was recommended in the Report that the Acting Director of Environmental Services be authorised to grant outline planning permission for the erection of a house at 30 Newmarket, Isle of Lewis, subject to the conditions detailed at Appendix 1 of the Report.

The Chairman invited Mr Ian Wilson, Planning Officer, to address the Sub-Committee, in accordance with the procedure for hearing applicants and objectors. Thereafter, the Chairman invited Mr George Simmons, who had made representations in relation to the above planning application, to present his case and to answer questions put by Members of the Sub-Committee.

   

It was agreed to defer consideration of the above application for outline planning permission, to allow the Sub-Committee to visit the site at 30 Newmarket, Isle of Lewis.

It was agreed to adjourn the meeting at 10.55am on Wednesday, 25 April 2001.

The meeting reconvened at 10.00am on Tuesday, 8 May 2001, in the Council Offices, Stornoway, where the following Members were found to be present:

It was agreed to adjourn the meeting at 10.04am to afford Members of the Sub-Committee an opportunity to visit the site at 30 Newmarket, Isle of Lewis.

The Sub-Committee reconvened at 10.40am on Tuesday, 8 May 2001, where the following Members were found to be present:

The Chairman invited Mr Ian Wilson, Planning Officer, to address the Sub-Committee in relation to the application for outline planning permission for the erection of a house at 30 Newmarket, Isle of Lewis, in accordance with the procedure for hearing applicants and objectors. Thereafter, the Chairman invited Mr George Simmons, who had made representations in relation to the above planning application, to present his case and to answer questions put by Members of the Sub-Committee.

 
   

It was agreed that the Acting Director of Environmental Services be authorised to refuse outline planning permission for the erection of a house at 30 Newmarket, Isle of Lewis, for the following reasons:

   

(1) the Comhairle considers that the proposed site located directly in front of an existing property does not respect the predominant pattern of individual houses in the township area and is therefore contrary to policy HS8 of the Finalised Broadbay Local Plan;

(2) the Comhairle considers that the proximity and orientation of the adjoining owner's property, to the rear of the site, is such that it will potentially give rise to overlooking and loss of amenity to the detriment of both properties. The development will, therefore, be contrary to policy DC1, in respect of the impact of the proposed dwelling on its surroundings, of the Finalised Broadbay Local Plan.
