CONSTITUTION

Applicants and Objectors at Sub-Committee Meetings

With reference to item 195 of the Minute of Meeting of 4 October 1995 the Director of Environmental Services submitted a Report concerning proposals to allow applicants and objectors to address the Development Services Sub-Committee. The Report gave details of the advantages and disadvantages associated with such a proposal and, in particular, referred to the recommendation of the Nolan Committee on Standards in Public Life that:

"there should be opportunities for applicants and objectors, and other interested parties such as Community Councils, to make representations to planning authorities"

and the advice contained within:

The Scottish Office Planning Advice Note, "Development Plan Departures" (Pan 41); and

The Scottish Office's "Review of the Town and County Planning System in Scotland".

   

It was intimated in the Report that a number of other local authorities including Orkney Islands Council, East Ayrshire Council, Glasgow City Council, The Highland Council and West Lothian Council had made provision to allow applicants and objectors to make representations at Committee or Sub-Committee Meetings and details of the hearings procedure for the Planning Referrals Sub-Committee of Orkney Islands Council were appended to the Report.

The Report suggested that in order to overcome difficulties associated with arranging times and venues for Sub-Committee meetings which should be both convenient for Members of the Comhairle and applicants or objectors and the impact of any delay in the Sub-Committee determining specific applications it would be appropriate to introduce the use of video-linking to allow applicants and/or objectors to address a Sub-Committee meeting in Stornoway from either the Comhairle Offices in Balivanich or the Comhairle Offices in Castlebay.

   

Full details of the proposed procedure for hearing applicants and objectors at the Development Services Sub-Committee were appended to the Report and it was suggested that the procedures be adopted on a trial basis for a period of one year.

   

It was agreed to recommend that;

(1) the Director of Corporate Services be authorised to invite applicants and objectors (or their representatives) to attend and speak to the Development Services Sub-Committee in accordance with the terms of the procedure detailed at appendix 1 of the Report, on the basis that the procedure be adopted initially for a trial period of one year; and

(2) the Director of Environmental Services and the Director of Corporate Services be requested to submit a Report, reviewing the appropriateness of the procedure for hearing applicants and objectors at the Development Services Sub-Committee, to the Committee in November/December 1999.

   

ECONOMIC DEVELOPMENT

Proposed Input/Output Economic Study

The Chief Executive submitted a Report regarding proposals to initiate an Input/Output Economic Study in partnership with other agencies. It was stated that a Western Isles Input/Output Study had been carried out in 1991 for the period 1988/89 and that there was an identified need to carry out a similar study in order to obtain up to date information. The proposed content of the study was outlined in the Report, together with the identified reasons for undertaking the study and an outline of how the study would be progressed. It was indicated that the estimated costs of the study were between £25,000 and £35,000 and it was proposed that these costs be divided between the Comhairle and Western Isles Enterprise. It was suggested that budgetary provision of up to £17,500 be made in the Comhairle's LEADER Budget for 1999/2000 on the basis that the project would not be completed in the current financial year.

It was agreed to recommend that:

the Chief Executive be authorised to contribute up to a maximum of £17,500 towards the costs of the new Western Isles Input/Output Economic Study with the funding to be identified in the Comhairle's LEADER Budget during the budget setting process for 1999/2000; and

(2) the Chief Executive be authorised to nominate Officers of the Comhairle to form, in partnership with other interested agencies, a Steering Group to oversee the delivery of the proposed Study.

Studio Drama Gàidhlig/Film Industry Marketing

The Chief Executive submitted a Report referring to the decision of the CCG to cease funding the Scottish Media Group to produce the TV programme "Machair". The Report gave details of the implications of this decision for Studio Drama Gàidhlig, Stornoway which had been used as the base for filming Machair during the period 1995 - 1998.

It was intimated that the Comhairle was actively engaged in marketing na h-Eileanan an Iar to the film and TV industry and that as Studio Drama Gàidhlig was used to attract film and TV companies to the Western Isles the substantial loss of revenue to the studio resulting from the CCG decision was a cause of major concern. It was intimated that Urras Studio Drama Gàidhlig contacted an external marketing consultant with a view to producing a marketing plan for the immediate future of the Studio and were consulting with the CCG, Western Isles Tourist Board, Western Isles Enterprise and Officers of the Comhairle on the production of a marketing strategy.

It was agreed to recommend that:

(1) the Report be noted; and

the Chief Executive be authorised to offer Urras Studio Drama Gàidhlig assistance to develop and implement its marketing strategy.

It was further agreed to recommend that the Chief Executive be authorised to make representations to the Scottish Media Group expressing the Comhairle's serious concern at the Group's proposals for the future use of the facility in Stornoway.

Extension to Community Employment Initiative

The Chief Executive submitted a Report regarding an application to the Objective 1 Partnership for European Social Fund funding to extend the Comhairle's existing Community Employment Initiative pilot project for one year. The achievements of the Community Employment project were outlined in the Report together with the proposals to extend the programme. It was stated that £107,531 would be required from the Comhairle to fund the extension, although this sum could be reduced if project sponsors were able to contribute financially towards new projects.

It was recommended in the Report that;

(1) the Comhairle homologate the action taken by the Chief Executive in applying to the Objective 1 Partnership for European Social Funding for a twelve month extension to the Comhairle's existing Community Employment Initiative;

(2) the Comhairle approve the sum of £107,531.00 to be expended as the Comhairle's contribution to the estimated costs for the calendar year 1999 with approximately £26,883 (falling in the 1998/99 budget) being considered in the context of the mid-year review with approximately £80,648 (falling in the 1999/2000 budget) being identified during the budget setting process for 1999/2000.

   

It was agreed to recommend that;

(1) the Comhairle homologate the action taken by the Chief Executive in applying to the Objective 1 Partnership for the European Social Funding for a twelve month extension to the Comhairle's existing Community Employment Initiative; and

(2) the Comhairle give consideration to the funding of the extension of the Community Employment Initiative, as detailed in the Report by the Chief Executive, on the basis that the Comhairle's contribution towards the project in the sum of £107,531 be met from provision with the Revenue Estimates as follows;

    1998/1999 £26,883

    1999/2000 £80,646

    subject to suitable progress with Objective 1 Funding of the project and on the basis of the funding source within the Comhairle's Budgets being determined in the context of the Comhairle's Budget Setting Exercise.

It was further agreed that the Chief Executive be requested to submit a Report to the Committee on the Comhairle's involvement in supported employment.

The New Deal: Welfare to Work: Council Involvement

The Chief Executive submitted a Report giving details of the present position concerning the Comhairle's involvement with the delivery of the New Deal in the Western Isles. It was intimated in the Report that the New Deal for 18 - 24 year olds afforded a range of four options, each including an element of educational training, to participants as follows:

a subsidised job with an employer;

full time educational training;

work with the voluntary sector; or

(4) work on the Environmental Task Force.

It was intimated in the Report that the Comhairle would take a lead role in the provision of the Environmental Task Force within the Western Isles and could either directly employ trainees or, if appropriate, sub-contract to other community based organisations and that it was not anticipated that referrals would be made by the Employment Service to the Environmental Task Force until the New Deal was extended to include the 25 plus age group.

   

It was agreed to recommend that:

(1) the Report by the Chief Executive be noted; and

(2) the Chief Executive be requested to submit Reports to the Comhairle detailing any further progress with the New Deal.

Bulb Trials

With reference to item 147 of the Minute of Meeting of 20 August 1997 the Chief Executive submitted a Report giving details of the outcome of the bulb trails undertaken at six sites in na h-Eileanan an Iar during the second year of the bulb project. It was intimated in the Report that whilst the result of the trials at the Tighgarry site had been outstandingly successful other sites had given a disappointing yield and it was proposed to seek advice from the Scottish Agricultural College prior to undertaking the third year bulb trials in more suitable areas.

Details of the estimated costs of the third year trials were given in the Report.

It was agreed to recommend that:

(1) the Comhairle continue to support the bulb trials; and

(2) the Chief Executive be authorised to allocate a sum up to £1,750 for bulb trials, on the basis that the costs involved be met from provision within the Revenue Estimates for Development Services (LEADER) for 1998/99 with LEADER II and Western Isles Enterprise funding the remaining cost of the trials.

Duthchas - Life Project

The Chief Executive submitted a Report giving details of the progress made in relation to the Duthchas Life Project. It was intimated that the Project was examining an alternative approach to rural development opportunities and that North Uist had been chosen as one of three pilot project areas the others being in North Sutherland and North Skye. Details of the management of the projects were given in the Report.

It was agreed to note the Report.

Harris Tweed Centre

With reference to item 15 of the Minute of Meeting of 29 January 1997 the Chief Executive submitted a Report indicating that following the decision of the Millennium Commission not to award grant aid towards the proposed Harris Tweed Interpretative Centre, Western Isles Enterprise had commissioned EKOS Limited, Economic Consultants, to examine potential funding for the project from the Heritage Lottery Fund and the National Lottery Charities Board. It was indicated that the Consultants had concluded that the Harris Tweed Interpretative Centre Project, in its current form, would not attract funding from the Heritage Lottery Fund or any other National Lottery funding source. It was suggested in the Report that it would be appropriate to investigate alternative sites in Harris for the location of the proposed Harris Tweed Interpretative Centre and re-examine the impact of any alternative site on likely visitor numbers.

It was agreed to recommend that:

the Chief Executive be authorised to commission an investigation of alternative sites in Harris for the proposed Harris Tweed Interpretative Centre, including a re-assessment of visitor numbers to the proposed Centre;

(2) the costs of the proposed investigation be shared equally by the Harris Tweed Authority, Western Isles Enterprise and the Comhairle up to a maximum total of £9000; and

   

(3) the contribution from the Comhairle be sourced from the Revenue Estimates for Development Services (LEADER) for 1998/99.

Harris Development Limited: South Harbour, Scalpay Request for Financial Assistance

The Chief Executive submitted a Report concerning an application for funding from Harris Development Limited towards Phase II of the works at South Harbour, Scalpay. The Report gave background information in relation to the application and intimated that there were no further funds available for Phase II of the South Harbour Project, although the proposal could be suitable for funding under the Members' Ward Initiative.

It was agreed to recommend that the Director of Corporate Services be authorised to inform Harris Development Limited that their request for £15,000 towards the material costs of the South Harbour, Scalpay, Project had not been acceded to.

   

CROFTING

SCU Seminar, Benbecula

The Chief Executive submitted a Report concerning a request for financial assistance from the Scottish Crofters Union towards the costs involved in staging an international seminar entitled The Production of Beef in Remote Areas of Europe. Details of the proposed conference were given in the Report and it was emphasised that the decrease in cattle numbers posed considerable environmental, social and economic consequences for na h-Eileanan an Iar. It was stated in the Report that the seminar would focus attention on the importance of cattle production in remote areas.

It was agreed to recommend that the Chief Executive be authorised to contribute up to a maximum of 20% of the total costs associated with the Scottish Crofters Union Seminar in Benbecula on the Production of Beef in Remote Areas of Europe, excluding travel and subsistence, equivalent to a maximum of £2642 conditional on:

(1) the seminar taking place as detailed in the Report;

(2) the submission of all receipts relating to seminar expenditure; and

(3) the submission of a seminar Report.

Lewis and Harris Auction Mart Limited

The Chief Executive submitted a Report concerning an application for financial assistance from Lewis and Harris Auction Mart Limited towards the cost involved in providing a Livestock Collection Scheme. It was intimated in the Report that the Collection Scheme would be of direct benefit to those crofters in Lewis and Harris who were disadvantaged as a result of the distance between their croft and the auction mart. It was anticipated that the costs of the service in future years would involve a charge to individual crofters.

It was agreed to recommend that the Chief Executive be authorised to provide a grant of £3,600 to the Lewis and Harris Auction Mart Limited to cover the costs of a Livestock Collection Scheme for crofters in Lewis and Harris.

   

The Chairman ruled, in accordance with the provisions of Section 50B(4) of the Local Government (Scotland) Act 1973 as detailed in terms of Standing Order 8(a) that the following item be considered as a matter of urgency in order to allow the Committee to take a view on the matter prior to the next meeting of the Comhairle.

Cast Ewes Sale 1998

The Chief Executive submitted a Report outlining the problems being faced by the crofting community in the Western Isles following a collapse in sheep prices. In particular the Report referred to the collapse for cast ewes market, i.e. ewes at the end of their breeding life, and intimated that if crofters were unable to sell their cast ewes it would result in overstocking over the winter months leading to serious animal welfare problems as well as environmental damage caused by overgrazing. The Report suggested that it would be appropriate to cover the freight charges involved in transporting stock from the Western Isles to a mainland location and outlined a special marketing assistance scheme for cast ewes. The Report commented on other options open to the Comhairle to address the cast ewe problem including:

a local cull; and

the purchase of stock by a local co-operative which could receive assistance with freight costs associated with transporting stock to a mainland market;

and highlighted the disadvantages associated with both of the above mentioned options.

The Report referred to the possibility that the Government would promote legislation that would allow the export of whole carcasses to France and that such a legislative change could result in an increase in the market price for cast ewes.

It was recommended in the Report that:

(1) the Comhairle keep a watching brief in the cast ewe situation over the coming weeks;

(2) the Chief Executive be authorised to make urgent representations to the Scottish Office seeking:

(a) the urgent re-opening of the French cast ewe market; and

(b) if necessary, Central Government financial intervention into the cast ewe difficulties found by Scottish hill farmers

(3) if considered appropriate by the Chief Executive, in consultation with the Chairman, and on a one off basis for 1998 only:

(a) the Comhairle fund a special Marketing Assistance Scheme to cover the freight charge of transporting cast ewes from the Western Isles to a destination on mainland Scotland or England at a maximum cost of up to £3.00 per head and for a maximum of 12,000 cast ewes (a maximum cost of £36,000); and

(b) payments be made through the existing market structure, i.e. to companies which have traditionally taken stock from the Islands.

It was agreed to recommend that the Chief Executive, in consultation with the Chairman, be authorised to take whatever action he deemed to be appropriate in connection with the cast ewes issue, including the implementation of the recommendations detailed in the Report.

   

The Committee unanimously agreed that, in accordance with the provision of paragraph 17 of the Scheme of Administration, the Committee determine the above recommendation on behalf of the Comhairle, under delegated powers, in light of the need to have the matter dealt with prior to the next Meeting of the Comhairle, on the basis that the recommendation was contentious and did not breach a major policy position of the Comhairle.

   

FISHERIES

Programme and Progress

The Director of Technical Services submitted a Capital Works Programme and Progress Report in respect of Fishery Piers.

It was agreed to note the Programme and Progress Report in respect of Fishery Piers.

   

It was agreed to recommend that the public, including the press be excluded from the meeting during consideration of the following item on the grounds that exempt information in terms of Standing Order 7A of the Local Government (Scotland) 1973 as defined in Standing Order 26(f), namely, information relating to the financial or business affairs of any particular person, other than the Comhairle, would be disclosed.

Ardveenish Pier Extension: Contract Costs

The Director of Technical Service submitted a Report regarding the increase in project cost for the work to extend the pier at Ardveenish, Barra. It was stated that the Project had been subject to re-tendering and an increased project cost of £526,000, including fees, had been reported in January 1998. It was indicated that the works on site were now completed and a further cost increase of £77,000 had been reported. Details of the additional costs were appended to the Report, together with explanations for the increases.

It was agreed to note the Report.

Fisheries Assistance Scheme

The Chief Executive submitted a Report outlining progress in the operation of the Fisheries Assistance Scheme and highlighting the need for additional funding to meet demand. It was stated that the Scheme had had a significant impact in creating new jobs and in encouraging investment in the Western Isles fishing fleet with finance in excess of £1.8 million being brought in from other sources. It was indicated that the level of interest in the Scheme from fishermen had surpassed expectations. The existing budget had been fully committed and there were a number of applications pending which would require additional funding to be made available. It was estimated that, in order to meet likely demand for the remainder of the financial year, further funding of £150,000 would be required

It was agreed to recommend that:

(1) the Chief Executive be authorised to investigate the potential for a new Fisheries Assistance Scheme with the Royal Bank of Scotland in order to ensure sufficient financial resources were available to cover the shortfall in funding, failing which;

(2) the Chief Executive be authorised to ensure that consideration be given to the approval of additional funding of £150,000 for the Fisheries Assistance Scheme, subject to funds being identified in the mid-year review of Revenue Expenditure.

Themed Years: A Review

With reference to item 126 of the Minute of Meeting of the Arts and Leisure Committee of 29 September 1998, the Chief Executive and Director of Education and Leisure Services submitted a joint Report concerning the current Programme of Themed Years and indicating that an appraisal of the approach to themed years should be undertaken and that such an appraisal be carried out in the context of the outcome of the Cultural Tourism Seminar to be held in December 1998.

   

It was agreed to recommend, insofar as the Committee's interest was concerned, that:

(1) the Programme of Thematic Years be the subject of an appraisal to be carried out in the context of the outcome of the Cultural Tourism Seminar; and

the Year of Norse 1999 be postponed to await the outcome of such an appraisal and that the Year of Gaelic be altered from 2000 to 2001.

   

POLICY PLANNING

Stornoway Airport Planning Brief

With reference to item 108 of the Minute of Meeting of 10 June 1998 the Chief Executive submitted a Report appending the Stornoway Airport Planning Brief which had been revised to take account of comments submitted during the consultation period for the Draft Planning Brief. Details of those organisations which had submitted comments on the Draft Planning Brief were also appended to the Report.

It was agreed to recommend that:

(1) the Stornoway Airport Planning Brief be approved for Development Control purposes; and

(2) the Chief Executive be authorised to circulate copies of the revised Stornoway Airport Planning Brief to the relevant organisations, including all those consulted on the Draft Brief and all those who had responded to it.

Draft National Planning Policy Guideline and Draft Planning Advice Note - Transport and Planning

The Chief Executive submitted a Report indicating that the Secretary of State for Scotland had sought comments on the Draft National Planning Policy Guideline (NPPG) and Draft Planning Advice Note (PAN) on Transport and Planning. It was intimated in the Report that the draft NPPG set out guidance on how the Government's policies for the Integration of Transport and Land Use Planning should be reflected in the operation of the planning system. In particular, the Report referred to the broad policy objectives contained within the draft NPPG which were:

(1) to promote a more co-ordinated view of transport and land use planning so that over time the disposition of land uses could assist in the reducing the need to travel;

(2) to create the right conditions for maximising the proportion of travel on foot, by cycle and by public transport; and

(3) to restrict adverse environmental impacts including breaches of the Statutory Air Quality Objectives and minimise environmental intrusion.

   

The Report further commented on the Draft Planning Advice Note on Transport and Planning and intimated that the Government did recognise the necessity for car ownership in rural areas for leisure, social and economic purposes and highlighted the importance of ferry and air services in rural areas.

It was agreed to recommend that the Chief Executive be authorised to respond to the Secretary of State on the draft National Policy Guideline and draft Planning Advice Note on Transport and Planning, on the basis detailed in the Report.

It was intimated in the Report that a European Marine Site Officer had been appointed and was currently engaged in a public consultation process in relation to the Loch nam Madadh special area of conservation.

It was agreed to recommend that the Director of Environmental Services be authorised to grant planning permission for the change of use of the Valtos Mission Hall, Uig, Isle of Lewis to residential use and to extend the building by adding a single story extension comprising two bedrooms and a bathroom in the terms detailed in the draft decision notice appended to the Report.

The Report gave background information and commented on the application and indicated that as the application was of a sensitive and complex nature it had not been determined by the Director of Environmental Services in terms of the Comhairle's Scheme of Delegation.

It was agreed to recommend that the Director of Environmental Services be authorised to grant planning permission for the continued use of land as a haulage depot at Bridge End, Creagorry, Benbecula on the terms detailed in the draft decision notice appended to the Report.

It was intimated in the Report that during the period 1911-1991 the population of na h-Eileanan an Iar had fallen from 46,732 to 29,370 a decline of 37%. It was stated in the Report that the projected population of the Western Isles in 2013 was 26,586. The Report concluded that the population of the Western Isles had been in significant decline since 1901 and that this decline had been more severe in particular geographical areas.

It was agreed to recommend that:

(1) the Report by the Chief Executive concerning population change in the Western Isles 1901-1991 be noted; and

(2) the Chief Executive be requested to submit a further Report to the Committee explaining the reasons for the population change in na h-Eileanan an Iar.

It was further agreed that the Director of Corporate Services be requested to include the letter of May 1997 to the Minister for Education and Industry at the Scottish Office concerning economic development in na h-Eileanan an Iar to the next Meeting of the Committee.

Local Authority World Heritage Forum: Application for Membership

The Chief Executive submitted a Report concerning an invitation to the Comhairle to join the UK wide Local Authority World Heritage Forum. The Report indicated that the Comhairle had received this invitation as St Kilda had been designated as a World Heritage Site and that as the St Kilda Island Group was owned by the National Trust for Scotland, with its management being the responsibility of Scottish Natural Heritage there would only be a limited role for the Comhairle to play in the work of the Forum.

It was agreed to recommend that the Director of Corporate Services be authorised to inform the UK Local Authority World Heritage Forum that the Comhairle would decline membership of the Forum.

With reference to item 95 of the Minute of Meeting of the Housing Committee of 29 September 1998, the Director of Housing and the Director of Corporate Services submitted a joint Report giving details of the discussions which had taken place with the Ministry of Defence in relation to the Comhairle's acquisition of 50 houses at Winfield Way and Winfield Close, Balivanich. The Report specifically provided information in relation to:

(1) the water supply/sewerage system;

(2) the relocation of tenants from Druim na h'Airde; and

(3) the proposed inclusion in the sale of the two Doran bungalows at Winfield Close.

   

It was intimated in the Report that the Ministry of Defence had indicated that it wished to include the two Doran bungalows, as detailed at Appendix 1 to the Report, in the sale of properties to the Comhairle and that the Director of Corporate Services and the Director of Housing were of the view that the inclusion of these properties was undesirable as their construction made them only fit for demolition, at an estimated cost of at least £6,000. The Report stated that, whilst discussions were ongoing with the Ministry of Defence in relation to the two Doran bungalows, the Ministry had indicated that they were prepared to consider making a payment to the Comhairle to cover the cost of demolition of the bungalows in exchange for the Comhairle undertaking to relocate the sitting tenants.

   

It was further intimated that the Ministry of Defence's Solicitors had confirmed that the Ministry would be negotiating with the North of Scotland Water Authority to adopt the water supply and sewerage system serving the 50 houses at Winfield Way and Winfield Close and that it had been confirmed that the Ministry of Defence would bear the whole cost of the necessary works. Details of the proposed relocation of the tenants of Druim na h'Airde, namely, Lasair Limited, Alzheimer's Scotland, Citizens Advice Bureau, Tighean Innse Gall and the Western Isles Health Board, were given in the Report.

   

It was recommended in the Report that:

(1) the position regarding the upgrading of the water supply and sewerage systems, be noted;

(2) the Director of Corporate Services be authorised to offer leases to Lasair Limited, Alzheimer's Scotland, Citizens Advice Bureau, Tighean Innse Gall and the Western Isles Health Board, on terms to be determined by him similar to those currently enjoyed and at a rental to be fixed by the District Valuer (Scotland North West); and

the Director of Corporate Services be authorised to proceed with the acquisition of the area extending to 1.438 hectares as shown on the plan attached to the Report, provided that the Director of Housing and the Director of Corporate Services could agree acceptable terms with the Ministry of Defence in respect of the demolition of the two Doran bungalows at Winfield Close.

   

It was noted that Peter Donaldson of Defence Housing Executive had stated, on 29 September 1998, that the Ministry of Defence were not prepared to contribute towards the demolition of the two Doran bungalows at Winfield Close and further reported that the Ministry did not wish to withdraw the two bungalows from the portfolio of houses and land offered to the Comhairle.

   

It was agreed to recommend that the Director of Corporate Services be authorised, as a matter of urgency, to arrange a meeting at which the Comhairle would be represented by:

Mr Alasdair Nicholson, Chairman Housing Committee;

Mr Norman L Macdonald, Chairman Development Services Committee;

Mr Donald Maclean, Vice-Chairman Development Services Committee;

Mr George Lonie, Vice-Chairman Housing Committee; and

Mr Colin Campbell, Member for the Benbecula Ward;

with a senior representative of the Ministry of Defence at which the following issues would be raised:

(1) the Doran bungalows at Winfield Close;

(2) the water supply/sewerage system; and

(3) the Ministry of Defence's future plans concerning the disposal of property at Balivanich.

The Committee unanimously agreed that, in accordance with the provisions of paragraph 17 of the Scheme of Administration, the Committee determine the above recommendation on behalf of the Comhairle, under delegated powers, in light of the need to have the matter dealt with prior to the next meeting of the Comhairle, on the basis that the recommendation was not contentious and did not breach a major policy position of the Comhairle.
