CONSTITUTION

The Principal Administrator chaired the meeting and called for nominations for the post of Chairman.

Mr James L Macarthur, seconded by Mr Donald Manford, moved the election of Mr Donald Maclean.

There being no further nominations, the Principal Administrator declared that Mr Donald Maclean had been duly elected as Chairman of the Sub-Committee for the period 1 November 2000 to the seven months ending immediately prior to the meeting of the Comhairle to be held in May 2001.

Request to Fell Tree at Bank of Scotland, Stornoway

DEVELOPMENT CONTROL

The Acting Director of Environmental Services submitted a Report concerning a request by the Bank of Scotland for consent to fell a tree to the rear of the Bank's premises at Cromwell Street, Stornoway, as the Bank considered that the tree was dangerously overhanging the car park area. It was stated in the Report that the Comhairle had received a Report from a Tree Consultant, who had concluded that the tree concerned was a healthy young sycamore which showed no signs of adversely affecting the adjacent boundary wall. It was stated that, as the tree was located on the northerly side of the rear yard area, it was unlikely to cast any shadow onto the yard area or the clothes dryer owned by the occupier of a flat overlooking the rear yard area. It was further stated in the Report that trees were an important element in the street scene and made a contribution to the character of Stornoway in general and the Conservation Area in particular and that the Comhairle, as Planning Authority, had been empowered to authorise the removal of trees when they were dead, dying or dangerous, or where it was clear that their appearance actually detracted from the character of the conservation area.

It was recommended in the Report that the request from the Bank of Scotland to fell the tree to the rear of the Bank's premises in Cromwell Street, Stornoway, as detailed in the Report, be refused, on the grounds that insufficient justification for the loss of this important tree had been put forward and that a Tree Preservation Order be placed on the tree referred to in the Report and the adjoining two trees, which formed a group, to protect them in the future.

   

It was agreed that, the Acting Director of Environmental Services be authorised to grant permission, in terms of Section 172 of the Town and Country Planning (Scotland) Act 1997, to fell the tree located in the rear yard of the Bank of Scotland, Cromwell Street, Stornoway, as referred to in the Report by the Acting Director of Environmental Services.

Extend House

34 Valtos, Uig, Isle of Lewis

PLANNING APPLICATIONS

The Acting Director of Environmental Services submitted a Report concerning an application for planning permission for an extension to the house at 34 Valtos, Uig, Isle of Lewis. It was intimated in the Report that, as the applicant's agent company was McLean Associates, in which Mr Philip McLean, Member for the Plasterfield Ward, had an interest, the matter be referred to the Sub-Committee for determination. It was further intimated that there was some concerns over elements of the design and layout submitted to the Comhairle and that these had been raised with the applicant's agent.

It was recommended in the Report that the Acting Director of Environmental Services be authorised to grant planning permission for an extension to the house at 34 Valtos, Uig, Isle of Lewis, subject to the conditions detailed in the Report.

   

The Acting Director of Environmental Services reported that discussions were still ongoing with McLean Associates in respect of the elements of design and layout submitted with the planning application for an extension to the house at 34 Valtos, Uig, Isle of Lewis.

   

It was agreed that consideration of the above planning application be deferred until the next meeting of the Development Services Committee on 22 November 2000, when the matter would be considered following the submission of a Report by the Acting Director of Environmental Services on the planning application.

Erection of Garage at 65 Leurbost, North Lochs

The Acting Director of Environmental Services submitted a Report concerning an application for planning permission for the erection of a garage at 65 Leurbost, North Lochs, Isle of Lewis. It was indicated in the Report that, as the applicant was Mr Harry T Miller, Assistant Director (Environment), the matter had been referred to the Sub-Committee for determination. It was further stated that the proposals, as submitted, were in conformity with planning legislation and would otherwise have been approved.

It was agreed that the Acting Director of Environmental Services be authorised to grant planning permission for the erection of a garage at 65 Leurbost, North Lochs, subject to the conditions detailed in the Report.

Erection of Agricultural Building at 28A Leurbost, North Lochs

The Acting Director of Environmental Services submitted a Report concerning an application for prior notification from Mrs Elizabeth J Miller, for the erection of an agricultural building at 28A Leurbost, North Lochs, Isle of Lewis. It was indicated in the Report that, as the applicant was the wife of Mr Harry Miller, Assistant Director (Environment) in the Environmental Services Department, the matter had been referred to the Sub-Committee for determination.

   

It was agreed that the Acting Director of Environmental Services be authorised to make no objections to the prior notification for the erection of an agricultural building at 28A Leurbost, North Lochs, Isle of Lewis.
