It was agreed that, in accordance with the provisions of Schedule 7A of the Local Government (Scotland) Act 1973, the press and public be excluded from the meeting during consideration of the following item on the grounds defined in Standing Order 26(a), namely, that exempt information relating to a particular employee, former employee or applicant to become an employee of, or a particular office holder or former office holder, or applicant to become an office holder under, the Comhairle would be disclosed. | ||

The Director of Corporate Services submitted a report indicating that Ms MM had submitted an appeal against a written warning under the disciplinary procedure. The Chairman invited into the meeting Mr William Macdonald, Headteacher, Sgoil Lionacleit, representing the Comhairle, Mr Stuart L Topp, Area Officer, Educational Institute of Scotland, representing the appellant and Ms MM, the appellant. |
Mr William Macdonald presented the case for the Comhairle, including calling Mr John Harrison, Depute Head Teacher, Sgoil Lionacleit, as a witness. The opportunity was given to Mr Topp to question Mr Macdonald and Mr Harrison. The Sub-Committee were given the opportunity to question Mr Macdonald and Mr Harrison. | ||
Mr Stuart L Topp presented the case for the appellant. The opportunity was given to Mr Macdonald to question Mr Topp and the appellant. | ||
The Sub-Committee were given the opportunity to question Mr Topp and the appellant. | ||
After final summing up by Mr Topp and Mr Macdonald, the parties withdrew from the meeting. | ||
After a full discussion of the matter, it was agreed that the appeal by Miss MM against a written warning be upheld for the following reasons: that no evidence was submitted which proved that the briefing document was confidential and the information contained in the briefing document was already in the public domain. The parties were then invited back into the meeting and informed of the Sub-Committee's decision. |
