It was agreed that, in accordance with the provision of Schedule 7A of the Local Government (Scotland) Act 1973, the Press and Public be excluded from the meeting during consideration of the following item on the grounds defined in Standing Order 26(a), namely, that exempt information relating to a particular employee of the Comhairle would be disclosed.

The Director of Corporate Services submitted a Report indicating that Ms Frances Macfarlane had submitted an appeal under the grievance procedure.

The Chairman invited into the meeting Mr Stuart Topp, Area Officer, Educational Institute of Scotland, representing the appellant; Ms Frances Macfarlane, the appellant; and Mr Murdo Macleod, Depute Director of Education, representing the Comhairle.

Mr Murdo Macleod asked that Mr Antony Cusack, Head Teacher, Castlebay School and a witness, Ms Kym Robinson, be permitted to be present during the meeting.

It was agreed not to accede to the request.

Mr Stuart Topp presented the case for the appellant.

The opportunity was given to Mr Macleod to question Mr Topp and the appellant.

   

The Sub-Committee were given the opportunity to question Mr Topp and the appellant.

   

Mr Macleod presented the case for the Comhairle including the calling of two witnesses, namely, Mr Antony Cusack and Ms Kym Robinson

   

An opportunity was given to Mr Topp to question Mr Macleod and the witnesses.

   

The Sub-Committee were given the opportunity to question Mr Macleod.

   

After final summing up by Mr Topp and Mr Macleod, the parties withdrew from the meeting.

   

After a full discussion of the matter, the Sub-Committee agreed that the grounds of the appeal by Ms Frances Macfarlane under the grievance procedure had been substantiated and the appeal be upheld.

   

Ms Macfarlane and Mr Macleod were then invited into the meeting and informed of the Sub Committee's decision.
