The Principal Administrator chaired the Meeting and called for nominations for Chairman of the Sub-Committee.

Mr Angus Nicolson, seconded by Mr Ian M Macleod, moved Mr Donald I Nicholson be appointed as Chairman of the Environmental Services Sub-Committee.

There being no other nominations it was agreed to appoint Mr Donald I Nicholson as Chairman of Environmental Service Sub-Committee.

The Minute of Meeting of 9 May 2001 was approved.

   

LICENSING

   

It was agreed that in accordance with the provisions of Schedule 7A of the Local Government (Scotland) Act 1973 the public, including the press, be excluded from the meeting during consideration of the following item on the grounds that exempt information in terms of Standing Order 26(f) would be disclosed, namely, information relating to the financial or business affairs of any particular person other than the Comhairle.

With reference to item 10 of the Minute of Meeting of 31 October 2000 the Director for Sustainable Communities submitted a Report detailing an application by Mr M A for a licence to act as a Street Trader. The Report detailed the concerns that had been expressed by the Environmental Health Section in respect of the application. Mr M A and the representative of the Director for Sustainable Communities were invited into the meeting to present their respective cases. Members of the Sub-Committee were given the opportunity to ask questions of Mr M A and the Director for Sustainable Communities representative. Both parties left the Meeting during consideration of the matter.

   

It was agreed that Mr M A's application for a Street Trader's Licence be approved for a period of two years and that the following conditions would be attached to the licence in addition to the standard licence conditions;

(1) the licensee shall comply with the relevant Consumer Credit Legislation relating to his activities

    In particular, and without prejudice to the foregoing, the licensee shall ensure that he provides his customers with an agreement, signed by both Mr M A and the appropriate customer containing the following information

    (i) Date of transaction;

    (ii) Description of goods;

    (iii) Cash price of goods;

    (iv) Deposit paid;

    (v) Total amount of credit charges; and

    (vi) Method of repayment.

(2) the licensee shall provide all his customers with a repayment book that contained a record of the amount of payments made by the customer and the date on which these payments were made.
