It was agreed to appoint Mr Norman A Macdonald as Chairman of the meeting.

APPEALS

It was agreed that the public, including the press, be excluded from the meeting during consideration of the following item on the grounds that exempt information in terms of Schedule 7A of the Local Government (Scotland) Act 1973, as defined in Standing Order 26(a), namely, information relating to a particular employee of the Comhairle would be disclosed.

Appeal Against Grading of Post

The Director of Corporate Services submitted a report regarding an appeal by Mr POD against the grading of his post. Appended to the report were the Comhairle's procedures for gradings hearings, papers submitted in support of the Comhairle's case and that of the Western Isles Local Government Branch, UNISON. Members were informed that the terms of UNISON's case had changed substantially since the initial submission and should be treated as a new appeal.

Mr William Whytock, Mr Donnie Mackenzie, Corporate Services Department, representing the Comhairle and Mr Alasdair Maclennan, UNISON, representing the appellant and Mr Peter O'Donnell were invited into the meeting. The Comhairle's representatives indicated that they wished to circulate a paper answering the precise terms of the appeal submitted by UNISON. Mr Maclennan and Mr O'Donnell indicated that they did not wish the additional paper to be circulated to members.

It was agreed that, as the terms of the appeal had changed substantially and constituted a new appeal, it would be necessary to undertake the hearing process again on the basis of the new grounds of appeal.
