		ROADS
		It was agreed that, in accordance with the terms of Section 50A(4) of the Local Government (Scotland) Act 1973 the public, including the press, be excluded from the meeting during consideration of the following item on the grounds that exempt information relating to the financial or business affairs of any particular person or the terms proposed or to be proposed by or to the Comhairle in the course of negotiations for a contract for the acquisition or disposal of property or the supply of goods or services would be disclosed.
Area Engineering Contracts 2002 - 2006 T12.62	1	With reference to item 127 of the Minute of Meeting of 21 November 2001 the Director of Technical Services submitted a Report in respect of the tender exercise for the Execution of Engineering Works Contracts 2002-2006. The Report outlined the details of the tenders which had been received and indicated that an independent evaluation of the tenders had been carried out by an external consultant. It was agreed that: (1) in relation to Area 1 the Comhairle convert to the Negotiated Procedure and invite Aggregate Industries Ltd and Comhairle nan Eilean Siar DSO to negotiate and the contract for Area 1 be extended by one month to allow such negotiation to take place, subject to the Scottish Executive agreeing to amend the appropriate milestones in the recovery plan; (2) in relation to Areas 2 and 3 the Execution of Engineering Works Contract be awarded to Comhairle nan Eilean Siar DSO for a period of 4 years from 1 April 2002 but, in line with the requirements of best value, further savings and the further development of best value be investigated with the contractor during the period of the contract; (3) in relation to Area 4 of the Execution of Engineering Works Contract be awarded to J Maclennan for a period of 4 years from 1 April 2002 subject to resolution of the issues surrounding TUPE being obtained to the satisfaction of the Director of Technical Services in consultation with the Director of Finance and the Comhairle's Legal Services Manager and Personnel and Training Manager; and (4) Members note that the contract provides for two possible annual extensions.
