| Loft conversions are
becoming an increasingly popular method of providing additional
accommodation in many houses. These always need a Building Warrant
and, in certain cases, Planning Permission.
The Comhairle is aware of a number of cases where the necessary
permissions have not been obtained. These have come to light during
the sale of a house following a normal property enquiry carried
out by a solicitor.
If the necessary permissions are not obtained, legal problems
and delays can arise particularly if the safety of the property
and the occupants may be affected.
If the work has been done without the required Building Warrant,
Comhairle nan Eilean Siar’s Building Control Section will
try to resolve the problem through discussion and consultation
with those concerned. In most cases this brings about a satisfactory
solution to the matter and enforcement action is not taken.
Angus Nicolson, Chairman of the Comhairle’s Environmental
Services Committee, said
“It is important that the public is made aware of the implications
of turning lofts into living accommodation. There are all sorts
of safety considerations that really need to be addressed properly
by applying for a building warrant before such works are undertaken.
It is in everyone’s interest to ensure that the right consents
are in place. I also think it is to be welcomed that the Building
Control Officers have highlighted this matter, particularly as
it seems as though a number of house sales are being delayed by
finding unauthorised loft conversions. I would urge anyone who
thinks they may have a loft conversion without a consent to contact
our Building Control Officers who will offer impartial advice
on how to resolve the matter."
